Agent & Co UK is an online recruitment service operating on the internet. It puts businesses and applicants for missions in touch with each other through the posting and consultation of job offers and by consultation of a databank of curriculum-vitaes uploaded by candidates.

The present conditions apply to internet sites run by or on behalf of Agent & Co UK and its affiliated companies, franchisees (Agent & Co) and subsidiaries.

The present Terms of Use are the property of Agent & Co UK. Any use of the present conditions, whether total or partial, is subject to the prior authorisation of Agent & Co UK. Anyone using these conditions without such authorisation is liable to incrimination and the civil and penal prosecution provided for by law.

The present Terms of Use apply to all the products and services offered for sale by Agent & Co UK, whether these are bought singly, in packages or by subscription.
By purchasing online services or using the services offered, the member declares that he or she uses Agent & Co UK services in compliance with applicable laws and with the following general conditions.

It is brought to the attention of members that Agent & Co UK is not the owner of the information contained in the on-line advertisements, and is therefore relieved of all liability in connection therewith.

Article 1 – Registering with Agent & Co Services
Registration with our services is carried out online, on the http://uk.agent-co.com website, by completing and validating a form after reading the present Terms of Use. Our services are reserved to adults who must be professionals registered with the British Commercial Registry. If you do not meet these conditions, you should not use our services. In addition, you are no longer authorised to use our services if your account has been temporarily or definitively suspended.
Article 2 – Using Agent & Co
Our site is an online support, the purpose of which is to enable companies and commercial agents to meet, by different methods, notably an “on-line adverts” system and an “online profile database” system commonly referred to as a “Profile-Bank". We host the content of adverts posted by companies (text, photos, etc.). We do not intervene in the transaction between the recruiter and the candidate. Consequently, we cannot control the security, truthfulness or accuracy of the adverts posted on-line, the capacity of the advertisers to propose job offers or the aptitude of candidates replying to online offers. We cannot ensure that recruiter and candidate will successfully contract with each other.
Article 3 – Privacy and data protection of Members
3.1 Personal information
- We collect the information that you choose to give, such as your e-mail or postal address.
- We collect non-personal information such as your type of browser, operating system and Internet pages visited to help us manage our sites.
- We use cookies and other internet technologies to manage our e-mail and internet programmes.
- It is possible that we may obtain additional information about you, such as demographic information, from available market sources.

3.2 Use
- We use your personal information in order to provide you with the services requested, to provide you with access to a personalised interactive use, and to help us to develop new services to meet your needs.
- We do not communicate your personal information to other commercial companies unless we have asked for and obtained your explicit consent. If you do not give your consent, we do not communicate your personal information.
- We use the personal information you have given us solely in accordance with the purposes for which you have provided it.
- When we supply personal information, temporarily, to the companies using our services, to consult the Profile-Bank, for example, we request these companies to protect the information in the same way that Agent & Co UK does. These companies cannot use your personal information for any purpose other than that for which you gave it to Agent & Co UK.

3.3 Your rights and choices
- You have the right to obtain a copy of the personal information you have supplied and to correct or update it.
- You can ask Agent & Co UK to cancel any prior consent that you may have given concerning the disclosure of your personal information to other companies.
- You can ask Agent & Co UK to remove you from the programmes you have subscribed to by means of the deregistration link present in our e-mail programmes.

3.4 Important information
- Agent & Co UK undertakes the commitment to work with its members to find a fair solution to any complaint or problem concerning confidentiality.
- Agent & Co UK respects British data protection laws.
- We shall cooperate with British data protection authorities if they believe that a problem of confidentiality has arisen.
- The confidentiality of our sites has been certified.
Article 4 – Prices and means of payment
Members can access paid services by bank card (on the internet or by telephone), by cheque or by bank transfer.
Agent & Co offers companies the possibility of consulting the Profile-Bank of candidates (commercial agents) also registered with Agent & Co. As the costs of establishing and managing these files vary, Agent & Co UK proposes different tariffs or free access to certain Member categories in accordance to the difficulties and costs of establishing and managing the files of the people sought for in one or another category. In any case, the prices and means of payment of the different Paid Services are presented below and are permanently accessible on the Agent & Co UK site, and at the latest during the presentation or use of the Paid Service(s) to which the Member wishes to subscribe, as well as their respective tariff(s).

Article 5 – Guarantee
The customer uses Agent & Co UK services at his own risks and perils. Agent & Co UK cannot, in any case, guarantee that the services proposed will never be interrupted. The obligation of provision incumbent upon Agent & Co UK is limited to due care.
Likewise, the information obtained by the customer within the framework of services proposed by Agent & Co UK, whether on the web site or by e-mail, do not give the right to any guarantee from Agent & Co UK insofar as it is not the producer of this information.
The articles proposed are in conformity with current British legislation. Agent & Co UK cannot be held liable in the event of non-respect of the legislation in effect in the countries where the services are bought.

THE ONLY GUARANTEE CONSENTED TO BY AGENT & CO UK BEARS ON THE MANAGEMENT OF AN INTERNET SITE WHICH PROVIDES THE CUSTOMER WITH THE SERVICE ORDERED, WITHOUT GIVING ANY GUARANTEE ABOUT THE QUALITY AND CONTENT, EVEN INSOFAR AS IT IS NOT THE PRODUCER OF THE DATA SUPPLIED. IN NO EVENT CAN AGENT & CO UK BE HELD LIABLE TOWARDS THE USER FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES, LOSS OF INFORMATION OR PROBLEMS ARISING DURING ELECTRONIC PAYMENT, COSTS ATTRIBUTABLE TO DELAYS OR TO THE OBTAINING OF REPLACEMENT SERVICES, WHATEVER THE CAUSE, BASED ON A THEORY OF LIABILITY (INCLUDING FORMAL, CONTRACTUAL, TORTIOUS, CONSECUTIVE ON DAMAGES WITHIN THE LIMITS AUTHORISED BY LAW AND CAUSED BY NEGLIGENCE), RESULTING FROM THE PRESENT CONTRACT. THESE LIMITS SHALL APPLY EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBLE INCIDENCE OF THE SAID DAMAGES AND NOTWITHSTANDING A BREACH OF THE PRINCIPAL OBJECT OF LIMITED RECOURSE.
Article 6 – Satisfied or refunded
You possess a right of being refunded of the services purchased on the Agent & Co UK site, under the conditions listed below:

This article only concerns the following services:

- Posting an advert on Agent & Co UK
Consulting the Agent & Co UK Profile-Bank
Recruitment advice and accompaniment service

One free repetition of the service is obligatory before any refund can be granted.

In the event of a request for refund, the customer must address his claim to Agent-co.com (contact@agent-co.com) to obtain a reply. Otherwise, the request may be rejected; the decision to refund is made by the management of Agent & Co. Our employees have no power of decision over the refund of an Agent & Co UK service.

In the event of a request for refund, following the customer’s lack of satisfaction, we undertake the commitment to repeat the service once and once only, free of charge. If the customer is still not satisfied, and after verification of the customer’s claim, the refund request will be considered receivable.

A refund can only be envisaged after verification of the customer’s remarks and statements. For example, if your job offer has attracted no candidates or if the Profile-Bank contains no candidate corresponding to your search, the refund will automatically be accepted. If, after verification, at least one candidate is found who corresponds to your search, then the refund will be considered but not automatically be granted.

Article 7 - Links
Agent & Co UK or a third party may establish a link to other sites or sources. Agent & Co UK has no means of controlling these sites and sources, and cannot answer for or guarantee the availability of such external sites and sources. Agent & Co UK does not appropriate the contents to which these sites or sources give access, and excludes all liability and guarantee with regard to these contents.
The links and, in particular, the searches are to a large extent performed automatically. Because of their large number, they can in no case be verified by the personnel of Agent & Co UK. If, however, in the pages of the agent-co.eu sites, a link is found to an external page containing illegal content distributed by a third party, Agent & Co UK will delete the link with this page, upon being informed of the aforementioned content.
Article 8 - Applicable law - attribution of jurisdiction
The present Terms of Use are governed and interpreted in accordance with British law. The British courts are competent to rule on any legal disputes that may arise between the parties in relation to the execution of the present.
Article 9 – Who are we?
Agent & Co, Société Anonyme (limited company) with a capital of 31,000 euros, represented by Mr. Willy LEGENDRE, CEO and Publication Director of the Agent & Co UK site. The Agent & Co UK site is hosted by the hosts of Agent & Co Canada, Agent & Co France and Agent & Co Luxembourg.

Reminder to candidates
Agent & Co advice:
• Never give your social security number (on the site)
• Never give personal information by telephone or e-mail (social security number, marital status, etc.)
• Be careful when dealing with contacts outside your own country

If you suspect that an offer is fraudulent, please inform us immediately by sending an e-mail to contact@agent-co.com and we shall take the necessary steps.
The effective date of the most recent modifications to the Terms of Use is 2008, April 10th.
